ZUMBA® WEAR INSIDER PROGRAM TERMS AND CONDITIONS
The Zumba® Wear Insider Program EUROPE (“Program”) is a rewards program offered by Zumba Wear Europe Ltd (“Zumba Wear Europe”). By participating in the Program, You accept the following Program Terms and Conditions (“Terms”). There is no cost to participate in the Program and You do not have to participate in the Program. The Program is sponsored by and administered by Zumba Wear Europe Ltd. Membership in the Program (“Membership”) is open to Zumba Instructor Network (“ZIN”) members who are in good standing, are at least 18 years of age, and have a primary registered shipping address within Europe. ZIN Members who meet this criteria are automatically enrolled in the Program.
Membership is limited to ZIN Members only and is limited to one account per individual. Employees, officers, ZW Resellers, directors, agents and representatives of Zumba Wear Europe are eligible for Membership when purchases have been made with their regular ZIN™ account, but may be excluded from certain benefits/promotions in at Zumba Wear Europe’s sole discretion.
This Program description sets forth terms and conditions that are applicable to members of the Program (“Member”, “You” or “Your”). Your Membership is non-transferable and is subject to present and future Terms as described below. These Terms are void where and to the extent prohibited by law.
Zumba Wear Europe reserves the right to interpret and apply the policies and procedures communicated in these Terms in its sole discretion, subject to applicable law. All determinations by Zumba Wear Europe will be final and conclusive in each case. These Terms supersede all previously published Terms in their entirety.
Eligibility
Zumba® Wear Insider 3 star
Zumba® Wear Insider 3 star status is conferred on ZIN™ Members who spend a minimum of €2,000 Excl. VAT on Zumba® Wear (excluding the purchase of gift cards, DVDs, equipment, trainings, taxes and/or shipping or handling charges) on www.zumbawear.eu, in Europe ZIN™ cart, over a consecutive 12 month period. Any returned Items will be deducted from this total (incl. a restocking fee). Zumba® Wear purchases at the Zumba® convention store or any other offline event or location does not qualify toward this minimum threshold. Zumba® Wear Insider 3 star status is good for the next quater, starting the month in which a Member qualifies; after that, quarterly requalification is required.
Zumba® Wear Insider 2 star
Zumba® Wear Insider 2 star status is conferred on ZIN™ Members who spend between €1,000 and €1,999.99 Excl. VAT on Zumba® Wear (excluding the purchase of gift cards, DVDs, equipment, trainings, taxes and/or shipping or handling charges) on www.zumbawear.eu in the Europe ZIN™ cart, over a consecutive 12 month period. Any returned Items will be deducted from this total (incl. a restocking fee). Zumba® Wear purchases at the Zumba® convention store or any other offline event or location does not qualify toward this minimum threshold. Zumba® Wear Insider 2 star status is good for the next quater, starting the month in which a Member qualifies, after that, quarterly requalification is required.
Zumba® Wear Insider 1 star
Zumba® Wear Insider 1 star status is conferred on ZIN™ Members who spend between €500 and €999.99 Excl. VAT on Zumba® Wear (excluding the purchase of gift cards, DVDs, equipment, trainings, taxes and/or shipping or handling charges) on www.zumbawear.eu, in the Europe ZIN™ cart, over a consecutive 12 month period. Zumba® Wear purchases at the Zumba convention store or any other offline event or location does not qualify toward this minimum threshold. Zumba® Wear Insider 1 star status is good for 12 months starting the month in which a Member qualifies, after that, quarterly requalification is required.
Eligibility Periods: The eligibility periods are announced every January, April, July, and October.
However tier levels are based on the following information:
January Tier Update: Purchases from December 15th of previous year to December 15th of current year.
April Tier Update: Purchases from March 15th of previous year to March 15th of current year.
July Tier Update: Purchases from June 15th of previous year to June 15th of current year.
October Tier Update: Purchases from September 15th of previous year to September 15th of current year.
Program Benefits
The Program benefits available to Members achieving Zumba® Wear Insider 1 star, Zumba® Wear Insider 2 star, or Zumba® Wear Insider 3 star status can be found at our overview page on Zumbawear.eu. Below are descriptions of some, but not all, of the benefits that are currently available to eligible Members at one or more of these status levels.
Birthday Offer Benefit: A birthday offer will be sent via email or via postal mail at Zumba Wear Europe’s sole option to eligible Members. To receive the birthday offer, Members must meet all requirements for eligibility in the Program and have a birthday date on file with Zumba Wear Europe webshop.
Early Notification to Sales, Collection Launches and New Products Benefit: Early Notification to Sales, Collection Launches and New Products may be sent from time to time and at Zumba Wear Europe’s sole option to eligible Members. To receive the notification of these benefits, Members must meet all requirements for eligibility in the Program. You understand that Zumba Wear Europe may not provide early notification for every sale, collection launch, and/or new product benefit announcement.
If Zumba Wear Europe provides you with early notification of collection launches and/or new product announcements, you agree not to advertise, market, promote, offer for sale and/or sell any of the new products prior to Zumba Wear Europe’s official launch of the products on zumbawear.eu.
Design Collaboration with the Zumba® Wear design team Benefit: From time to time, Zumba® Wear Insider 3 star Members may be eligible to participate on a design collaboration with the Zumba® Wear design team. The collaboration session will be selected by Zumba Wear Europe in its sole and exclusive discretion. If travel is necessary, unless otherwise agreed to by Zumba in writing, any and all costs or expenses associated with participating in or travelling to these events will be borne by the Member. As certain events might be limited in terms of the number of participants, You understand and acknowledge that not all Members will be invited to, or be able to attend, all sessions.
Invitation to Zumba Events Benefit: From time to time, Members may be eligible to participate in certain Zumba events (e.g., a Zumba® Wear photo shoot). Members who are invited to these events will be selected by Zumba Wear Europe in its sole and exclusive discretion and, unless otherwise agreed to by Zumba Wear Europe in writing, any and all costs or expenses associated with participating in or travelling to these events will be borne by the Member. As certain events might be limited in terms of the number of participants, You understand and acknowledge that not all Members will be invited to, or be able to attend, all events.
Free Standard pickup point Shipping Benefit: Zumba® Wear Insider 3 star Members will receive from time to time free shipping codes to receive free standard shipping on a new purchase made on www.zumbawear.eu in Europe. Offer not valid on international Non-EU / Island shipping. Zumba® Wear Insider 3 star Members must check out with a valid account to receive the free shipping offer. No adjustments will be made to previous purchases. The offer is connected to your personal ZIN™ account, non-transferable and is subject to change, alteration, or termination by Zumba Wear Europe in its sole discretion at any time.
From time to time Zumba Wear Europe may modify, delete, or make additional offers or benefits available to Members of the Program who meet certain eligibility requirements established by Zumba Wear Europe in its sole discretion.
Email Communications
Members that have provided an email address for usage with the Program will be sent electronic statements, Rewards certificates, Program benefits, and other materials related to Your Rewards account and transactions at zumbawear.eu at the discretion of Zumba Wear Europe. Zumba Wear Europe reserves the right to suspend
or discontinue the emailing of Program updates, Rewards Certificates, and/or related materials to Members at any time and for any reason or no reason at all.
By providing an email address and participating in the Program, You agree to receive from Zumba Wear Europe promotional email offers, emails providing information about Zumba programs and events, and emails with updates concerning the Program. Members may unsubscribe from promotional emails at any time via the unsubscribe link in those emails.
Zumba Wear Europe is not responsible for undelivered, mis-delivered, or delayed email transmissions or for incorrect email addresses and other contact information resulting from incorrect or incomplete personal information (including, without limitation, email address or other contact information) provided by a Member or for a Member’s failure to notify Zumba Wear Europe of a change in such information. You must make sure that Your email address on file with Zumba Wear Europe is accurate and up to date in order to receive email communications.
Information about You will be maintained and handled according to Zumba Wear Europe’s Privacy Policy.

Privacy Policy
Zumba Wear Europe values Your privacy. The personal information collected from each Member, including purchase history and credit card information, will only be used and disclosed by Zumba Wear Europe for the purpose of the administration of the Program, internal analysis for marketing purposes, and as otherwise permitted by Zumba Wear Europe’s Privacy Policy. Changes, Termination or Removal from the Program
Zumba Wear Europe may, in its sole discretion, alter, limit, or modify these Terms or the Program rules, regulations, benefits, eligibility requirement for Membership, or any other feature of the Program (including assigning any of its obligations to customers under the Program at any time to another person or entity, without recourse), at any time, without prior notice. Zumba Wear Europe further reserves the right to terminate the Program or any Program benefits at any time without notice. It is Your responsibility to check or review these Terms from time to time to keep informed of any changes. By participating in the Program, You hereby agree to be bound by any such changed Terms.
Zumba Wear Europe reserves the right to make promotional offers, Zumba Wear Europe reserves the right to add, withdraw, amend, or otherwise change bonus opportunities at any time at its sole discretion, with or without notice to Members.
Zumba Wear Europe reserves the right to exclude individuals from the Program in its sole discretion. Any abuse of the Program, failure to follow the Terms or Program rules, any misrepresentation or any conduct detrimental to the interests of Zumba® or Zumba® Wear Eur may subject Members to Membership revocation and will affect eligibility for further participation in the Program. Membership is non-transferable and the Member must make Membership purchases. If Your ZIN membership lapses, is invalid, revoked, terminated, or otherwise cancelled, Your Membership in the Program will automatically terminate.
Limitation of Liability
ZUMBA WEAR EUROPE IS NOT LIABLE FOR ANY DAMAGES OF ANY KIND ARISING OUT OF OR IN CONNECTION WITH YOUR PARTICIPATION OR MEMBERSHIP IN THE PROGRAM, INCLUDING DAMAGES ARISING OUT OF CHANGES TO OR TERMINATION OF THE PROGRAM. THIS IS A COMPREHENSIVE LIMITATION OF LIABILITY THAT APPLIES TO ALL DAMAGES OF ANY KIND, INCLUDING BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, PUNITIVE OR CONSEQUENTIAL DAMAGES, LOSS OF DATA, INCOME OR PROFIT, LOSS OF OR DAMAGE TO PROPERTY AND CLAIMS OF THIRD PARTIES. TO THE EXTENT PERMITTED BY LAW, THE LIMITATIONS ON ZUMBA WEAR EUROPE'S LIABILITY SET FORTH HEREIN SHALL APPLY WHETHER FOR BREACH OR REPUDIATION OF CONTRACT, OR WHETHER IN TORT, CIVIL LIABILITY BY WAY OF NEGLIGENCE, GROSS NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. BY AGREEING TO THESE TERMS, YOU WILLINGLY AGREE THAT YOU HAVE RELINQUISHED YOUR RIGHT TO SEEK THESE DAMAGES FROM ZUMBA WEAR EUROPE AND THAT THIS IS A REASONABLE ALLOCATION OF RISK.
Intellectual Property Rights
The Zumba® logo, Zumba® Wear Insider logo, and other logos, designs and taglines associated with the Program are the exclusive intellectual property of Zumba Fitness LLC. All copyrights, trademarks, and other proprietary rights associated and/or connected with the Program are reserved to Zumba Fitness LLC.
If you believe any content associated and/or connected with the Program infringes your copyright, please provide our Copyright Agent with the following information: (a) an electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest; (b) a description of the copyrighted work that you claim has been infringed; (c) a description of the content you claim is infringing and where it is located; (d) your address, telephone number, and email address; (e) a written statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent or the law; (f) a statement by you, made under penalty of perjury, that the above information is accurate and that you are the copyright owner or authorized to act on the copyright owner’s behalf. Counter notification, as permitted by applicable law and, in particular, the Digital Millennium Copyright Act, may be sent to Zumba Fitness LLC’s designated agent listed below. All counter notifications must include responsive
information to what is set forth above including any required statements or signatures. Applicable Law
The American Program is created and controlled by Zumba Fitness LLC, which is located in the State of Florida, U.S.A. As such, the laws of the State of Florida will govern the Intellectual property terms these Terms, without giving effect to any principles of conflicts of laws.You hereby consent to the exclusive jurisdiction of courts located in the State of Florida.
EUROPE
The Insider program has it's own program in Europe is excecuted by Zumba Wear Europe Ltd, As such, the laws of the state for Varna, Bulgaria govern all other terms. You hereby consent to the exclusive jurisdiction of courts located Varna Bulgaria.
Zumba Wear Europe and Member each agree to submit to the exclusive personal jurisdiction and venue of Varna County, in Varna, Bulgaria, or of any federal court located in Varna county for resolution of any and all disputes related to the Terms, the Program, and/or Your Membership in the Program.
Zumba Wear Europe and Member acknowledge and understand that, with respect to any dispute: YOU ARE GIVING UP YOUR RIGHT TO SERVE AS A REPRESENTATIVE, AS A PRIVATE ATTORNEY GENERAL OR IN ANY OTHER REPRESENTATIVE CAPACITY, OR TO PARTICIPATE AS A MEMBER OF A CLASS OF CLAIMANTS, IN ANY LAWSUIT INVOLVING ANY DISPUTE CONCERNING THESE TERMS, THE PROGRAM, AND/OR YOUR MEMBERSHIP IN THE PROGRAM.
