Share & Earn Program | Terms & Conditions

1. Introduction

These Terms & Conditions ("Agreement") govern participation in the Zumba Wear Europe Share & Earn Program ("Program") operated by Zumba Wear Europe Ltd ("Company"). By participating in the Program, the participant ("Affiliate") agrees to comply with these terms.

2. Eligibility

• Affiliates must be at least 18 years old or the legal age in their country.
• Affiliates must provide accurate and up-to-date account information.
• The Program is open to individuals who wish to share Zumba® Wear with their community.
• The Company reserves the right to suspend or remove participation in cases of misuse or violation of these terms.

3. How the Program Works

• Affiliates receive access to a personal Share & Earn link via their account dashboard.
• Links can be shared directly or generated through the website share button.
• Orders placed through the Affiliate’s link are automatically connected to their account.
• The Program is intended to reward natural sharing and community engagement.

4. Commission

• Commission applies to purchases made by regular customers using the Affiliate’s link.
• Purchases made by discounted or professional accounts (including instructors, ZES, ZJ, Zumba Wear resellers, or partners) are not eligible.
• Affiliates do not earn commission on their own purchases.
• Commission is calculated on the net order value (excluding VAT, shipping, discounts, and returns).
• If an order is cancelled or refunded, the related commission will be removed.
• If items are returned, the commission will be adjusted accordingly.
• During certain promotions or flash sales, commissions may be excluded or adjusted.

5. Tracking & Attribution

• All tracking is handled automatically through the Affiliate’s personal link.
• The Company does not guarantee tracking in cases where technical limitations apply (e.g., browser restrictions, ad blockers, or user settings).
• Only completed and valid orders are eligible for commission.

6. Payouts

• Payouts are processed on a monthly basis.
• A minimum balance of €50 is required before a payout can be made.
• Affiliates can choose to receive payment via invoice (bank transfer) or as a Zumba Wear voucher.
• Affiliates will receive instructions via email when eligible for payout.
• Affiliates are responsible for any applicable taxes or fees.

7. Promotional Guidelines

• Affiliates must promote the brand in a respectful and authentic manner.
• Misleading, false, or exaggerated claims are not allowed.
• Spam, unsolicited messaging, or aggressive sales tactics are prohibited.
• Affiliates may not impersonate the Company or act as an official representative.
• Paid advertising using the Company’s brand name without permission is not allowed.

8. Intellectual Property

• All trademarks and brand assets remain the property of Zumba Fitness LLC and its licensors.
• Affiliates may use approved materials for the purpose of sharing and promoting the Program.
• Materials may not be altered or misused without written permission.

9. Data Protection & Privacy

• Affiliates must comply with applicable data protection laws (e.g., GDPR).
• Affiliates may not collect, store, or misuse customer data.

10. Term & Termination

• The Agreement remains active while the Affiliate participates in the Program.
• The Company may suspend or terminate participation at any time in cases of abuse, fraud, or violation of these terms.
• Upon termination, access to the Program will be revoked.
• Eligible unpaid commissions above the minimum threshold will be paid in the next cycle.

11. Limitation of Liability

• The Company is not liable for indirect or consequential damages related to the Program.
• Participation in the Program is at the Affiliate’s own risk.

12. Changes to the Program

• The Company reserves the right to modify the Program, including commission rules, at any time.
• Updates will be published on the website.
• Continued participation constitutes acceptance of updated terms.

13. Governing Law

• This Agreement is governed by the laws of Bulgaria.
• Any disputes will be handled in the courts of Varna, Bulgaria.

14. Miscellaneous

• This Agreement represents the full agreement between the parties.
• If any provision is invalid, the remaining terms remain in effect.
